  • General Provisions

  1. The following GTC determine the general conditions, the type of service provided electronically and of sales through the online shop www.wallframes.store

hereinafter referred to as the "Online Shop" or "Seller". The contract language is German.

  1. Purchases can be made in the following languages: German, English, Polish.

  2. The following GTC are accessible at any time on the website www.wallframes.store, can be viewed, and can be saved by printing or recording on a data carrier.

  3. The Seller informs that using the service electronically involves the risk for every internet user of harmful software being introduced into their own computer system and the acquisition and modification of their personal data by unauthorized persons. To minimize the risk, the customer should take the necessary technical precautions that minimize this threat, in particular antivirus software and a firewall.

  • Definitions

  1. Order – the customer's declaration of intent that directly leads to the conclusion of a sales contract and specifies in detail the type and quantity of the goods.

  2. Sales Contract – the contract concluded between the Seller and the Customer for the sale of goods;

  3. Customer – a natural person with legal capacity, a natural person engaged in commercial activity, a legal person, or an organizational unit with legal capacity according to specific regulations, who places an order in the online shop or uses other services available therein;

  4. Entrepreneur – is a natural or legal person or a legal partnership that acts in the exercise of their commercial or independent professional activity when concluding a legal transaction (§ 14 I BGB - German Civil Code).

  5. Consumer – is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activity (§ 13 BGB - German Civil Code).

  6. Goods – the product offered in the online shop, which is provided with a product description in each case;

  7. Working Days – days from Monday to Friday excluding public holidays designated as non-working days;

  • Terms of Use of the Online Shop

  1. The use of the online shop requires the fulfillment of the minimum technical requirements by the customer's IT system:

    1. Computer or mobile device with internet access,

    2. Access to electronic mail,

    3. Browser Internet Explorer 11 or higher, Firefox 28.0 or higher, Chrome 32 or higher, Opera 12.17 or higher, Safari 1.1. or higher,

    4. Allowing cookies and Javascript in the internet browser.

  2. The use of the online shop is equivalent to any action of the customer that leads to them becoming aware of the content contained in the online shop.

  3. The customer is obliged above all to:

    1. Refrain from publishing and forwarding content prohibited by law, e.g., calls for violence, defamation, or violations of public welfare, or infringement of third-party rights,

    2. Use the online shop in a way that does not disrupt its operation, especially by using certain software or devices,

  4. Refrain from actions such as: sending or offering unsolicited commercial information (spam) in the online shop,

    1. Use the online shop in a way that does not constitute a nuisance for other customers and the online shop,

  5. Use all content offered within the online shop exclusively for private use,

    1. Use the online shop in accordance with the regulations applicable in Germany, in accordance with the GTC, and in accordance with the general rules of internet use.

  • Services

  1. The Seller enables the use of free services via the online shop, which are offered by the Seller 24 hours a day, 7 days a week.

  2. The customer can reach the seller by phone or email. Consequently, a contract is concluded, the purpose of which is to answer the customer's inquiry. This contract is concluded for a specific time and ends at the moment the Seller answers the customer's inquiry.

  3. The customer can receive commercial messages from the service provider in the form of messages sent to the email address provided by the customer (newsletter). To do this, a valid email address must be provided or the corresponding field in the registration form or order form must be activated and the registration confirmed by clicking on a link in the confirmation email. The customer can revoke consent to the transmission of commercial information at any time. The contract is concluded for an indefinite period and ends when the customer sends a request to remove their email address from the newsletter subscription or clicks on the revocation link located in every newsletter message.

  4. The customer may add individual and subjective contributions to the online shop, which relate, among other things, to the goods or the transaction process. By adding a contribution, the customer declares that they have all rights to these contributions, especially copyrights. This contract is concluded for an indefinite period and ends when the customer submits a rating.

  5. The contributions should be created transparently and understandably. They must not violate the applicable legal regulations, including the rights of third parties – in particular, they must not defame, violate physical integrity, or constitute unfair competition. The provided contributions are published on the pages of the online shop.

  6. By providing a contribution, the customer consents to its free use and publication by the provider as well as the editing of the works.

  7. The online shop has the right to occasionally organize competitions and special promotions, the conditions of which are published on the online shop's websites in each case. The special offers in the online shop cannot be combined, unless the respective conditions allow this.

  8. In the event of a violation of these GTC by the customer, the Seller may, after prior request to cease or remove the prohibited content, with a reasonable deadline, terminate the service contract with a notice period of 14 days.

  • Order Process

  1. The information about goods given on the online shop's websites, in particular their descriptions, technical and usage parameters, and their prices, do not yet constitute a binding offer (on our part). The presentation of the goods is only an invitation to conclude a contract.

  2. All goods offered in the online shop are factory new, free from physical and legal defects, and have been legally introduced to the German market.

  3. The condition for placing an order is having an active email account.

  4. The order form is available on the online shop's website for placing an order. The order is placed by the customer with the Seller in electronic form and constitutes an offer for the ordered goods. The offer submitted in electronic form is binding for the customer when the Seller sends an order confirmation to the email address provided by the customer, which is a declaration of the Seller's acceptance of the customer's offer. The sales contract is concluded at this time.

  5. Entrepreneurs can also place an order by email. Placing an order by email takes place on working days during the online shop's opening hours. Therefore, the entrepreneur must provide the Seller with the following information:

    1. the name of the desired goods (which can be found on the shop's pages), and the desired quantity of goods;

    2. the type of delivery and payment (from those available on the shop's pages);

    3. the personal data that the Seller needs for the ordering process, in particular: name, surname, delivery address, email address

  6. The Seller informs the customer by electronic message about the total value of the order and that the conclusion of the contract obligates the customer to pay. A sales contract is concluded at this moment.

  7. The information about the total value of the order is communicated by the Seller by email after the entire order has been completed. The conclusion of the sales contract by the customer includes the obligation to pay for the ordered goods. The contract is concluded at this moment.

  8. After concluding the sales contract, the Seller confirms the contract terms to the customer by sending them to the customer's email address or in writing to the address provided by the customer.

  9. The Seller stores the contract text after the conclusion of the contract. The Seller does not provide the customer with access to the contract text.

  • Delivery

  1. Delivery takes place to the address provided by the customer when placing the order, but only within the Federal Republic of Germany.

  2. Delivery is carried out by: courier service.

  3. The Seller informs the customer through descriptions on the online shop's websites about the number of working days for processing and delivery of the order, as well as the shipping costs.

  4. The delivery time and the processing of the order are calculated in working days according to VII 2.

  5. The Seller sends the invoice with the order, at the customer's request.

  6. If different processing times apply to the ordered goods, the longest of all planned times applies to the entire order.

  7. Prices and Payment Methods

  8. All goods prices are total prices, stated in EUR, and include all taxes and duties (incl. VAT).

  9. Payment is made by means of:

    • PayPal – with this payment method, you will be redirected to PayPal to complete the payment process. For this, you must provide the personal data requested by the chosen payment processor. (in this case, order processing begins after an order confirmation has been sent to the customer and the Seller has received confirmation of payment. Shipping takes place immediately after the order is completed);

    • Klarna – with this payment method, you will be redirected to PayPal to complete the payment process. For this, you must provide the personal data requested by the chosen payment processor. (in this case, order processing begins after an order confirmation has been sent to the customer and the Seller has received confirmation of payment. Shipping takes place immediately after the order is completed);

    • Online transfer (in this case, order processing begins after an order confirmation has been sent to the customer and the Seller has received confirmation of payment. Shipping takes place immediately after the order is completed);

    • Electronic payment system Stripe – Card, PayPal, Klarna

    • Conotoxia Pay – Apple Pay, Debit card, EPS, Google Pay, iDEAL, PayPal, Online transfer, Rapid Transfer, Skrill Wallet, Trustly, UnionPay

  10. The Seller informs the customer on the online shop's websites about the payment deadline for the order. If no payment is recorded from the customer within this period, the Seller may withdraw from the contract, after prior request for performance or supplementary performance within a reasonable deadline.

  11. The delivered goods remain the property of the online shop until full payment. As long as this retention of title exists, the customer may not resell the goods or dispose of the goods (retention of title).

  • Right of Withdrawal

Consumers have a right of withdrawal for distance contracts in accordance with § 355 BGB.

  • Return outside the Right of Withdrawal

  1. For goods that are not prefabricated and for the production of which an individual selection or determination by the customer is decisive or which are clearly tailored to the personal needs of the customer, there is no statutory right of withdrawal. Nevertheless, the online shop allows you to return them in these cases, which can take place within 30 days from the date of the contract.

  2. The prerequisite for the return is that the goods show no signs of use or have not been assembled.

  3. Shipping costs for returning the goods, as well as new packaging and the corresponding protection, are borne by the customer.

  4. The price refund will be made within a maximum of 14 days in the same form of payment or transfer to an account specified when placing the order.

  • Warranty

  1. The goods can be provided with a manufacturer's or importer's warranty.

  2. In the case of products with a warranty, information about the warranty and its content, as well as the warranty period, is contained in the product description on the offer pages of the online shop.

  3. Liability for Defects (Gewährleistung)

  4. The Seller undertakes to deliver defect-free goods.

  5. The Seller is responsible to the customer for defects within the statutory warranty period.

  6. If the consumer purchases used goods, claims for defects are excluded if the defect occurs after one year from the delivery of the goods.

  7. If the entrepreneur purchases new (newly manufactured) goods, the limitation period is one year from the delivery of the goods.

  8. If the entrepreneur purchases used goods, all claims for defects are excluded. § 445a BGB remains unaffected.

  9. The Seller is not liable to the entrepreneur for public statements made by the manufacturer. Only the information about the quality of the goods agreed between the Seller and the buyer (entrepreneur) applies (manufacturer's product description and the Seller's information about the goods).

  10. In the event of injury to health, body, or life and breaches of duty (intent, gross negligence, malice) caused by the online shop, the statutory provisions apply.

  11. In all other respects, the statutory rules on liability for defects apply.

  • Complaints within the Warranty Period

  1. Complaints that:

    • arise from violations of the legally granted customer rights from these GTC,

    • or relate to the functionality of the online shop and the use of the services should be addressed to the following address:

  1. For the purpose of complaint processing, the customer must send or hand over the complained goods, if possible, together with the proof of purchase. The goods must be sent or handed over to the address listed in point 3.

  2. In the complaint letter, the customer should state their first and last name, correspondence address, as well as the nature and description of the problem that occurred.

  3. The Seller undertakes to process every complaint within 14 days.

  4. In case of incompleteness of the complaint, the Seller will ask the customer to complete it immediately, but no later than 7 days after receiving the request.

  • Out-of-court settlement of complaints and raising claims

In the event of a dispute, the consumer can file a complaint using the EU internet platform – OS platform (Online Dispute Resolution), at the internet address: http://ec.europa.eu/consumers/odr/.

  • Data Protection

The personal data provided by the customer are collected by the Seller and processed in accordance with the applicable legal regulations and in accordance with the data protection provisions contained in Annex No. 2 to these GTC.

  • Final Provisions

  1. All rights to the online shop, including copyrights, intellectual property rights to its name, the internet domain, the online shop's website, as well as to forms, logos are the property of the Seller and their use may only take place in a specified manner and in accordance with the GTC.

  2. The courts of jurisdiction for settling any disputes between the Seller and the customer as a consumer remain the competent courts in accordance with the provisions of the German Code of Civil Procedure.

  3. The court of jurisdiction for settling any disputes between the Seller and the customer as an entrepreneur remains the court competent for the Seller's registered office.

  4. In matters not regulated by these GTC, the provisions of German law apply.

  5. Should a provision of this contract be or become wholly or partially invalid or void, the statutory regulation shall take its place. The validity of the contract is not affected by this.

  6. Every customer will be informed of any changes to the GTC by information regarding the changes and the date of their entry into force on the online shop's homepage. The changes shall enter into force no later than 14 days after their announcement. Notification by the Seller of the rejection of the new version of the GTC results in the termination of the contract.

 

§ Copyright and Indemnification

  1. The Client declares that they hold all necessary copyrights, licenses, and permissions for the images and materials submitted for printing.

  2. The Client assumes full responsibility for any infringement of third-party rights (including copyright and personal rights) arising from the execution of the order based on the submitted materials.

  3. The Client agrees to indemnify and hold the Service Provider harmless from any claims, damages, liabilities, costs, and expenses (including legal fees) arising from any breach of the above declaration or from the use of the submitted materials.
